Terms of Service
Draft pending legal review
WakeSync is booking, payments and operations software that marinas, boat rental companies, campgrounds and RV parks (the operators) use to sell and run their rentals. These terms cover two groups: guests who book through an operator's booking page, and operators and their staff who use the WakeSync console. WakeSync (we) provides the software. By booking or using an account you agree to these terms.
1. Who you are dealing with
When you book, your contract for the rental is with the operator, not with us. The operator sets the prices, the rental agreement, the cancellation policy, safety rules and any deposits, and is responsible for the rental itself, the equipment and its staff.
The operator is the merchant of record. Your card statement shows the operator's name. We provide the booking page, checkout and records on the operator's behalf.
2. Booking and holds
While you check out, the rental you picked is held for a short time, shown on the page. If the hold runs out before payment completes, the rental may be released to someone else; if that happens after you paid, the payment is refunded automatically.
Prices shown include everything except tax unless the page says otherwise. There are no booking fees charged to guests by WakeSync.
Some bookings need a deposit today and the balance later. The booking page shows what is due today, the balance and when it will be charged.
3. Payments and your saved card
Payments are processed by Stripe on the operator's Stripe account. We never see or store your full card number.
When you agree to the card on file terms at checkout, the operator may charge the saved card for the remaining balance and for charges under the rental agreement, such as fuel, damage, cleaning, late return or items added during your rental. You receive a receipt for every charge. If a later charge is declined, you receive a secure link to pay.
4. Cancellations, changes and refunds
Each operator sets its cancellation policy, shown before you pay and in your confirmation. Weather, safety and operator cancellations are handled by the operator, who may offer a refund, a new time or a rain check. Card refunds usually take 5 to 10 business days to appear. Questions about a refund go to the operator first; contact details are on your confirmation.
5. Electronic signatures and required forms
You may sign the rental agreement and other forms electronically, including forms required by state law for boat rentals. Your typed name and drawn signature, the exact text you signed, the time and your device details are recorded. An electronic signature has the same effect as signing on paper. Some forms, such as a pre-rental safety instruction statement, are signed in person at the dock.
Waivers, releases, policies and rental agreements are provided by the operator, not by WakeSync. WakeSync provides the software you sign them with and is not a party to them. Every adult aboard may be asked to sign the operator's release, and a parent or legal guardian signs for each child. You can get a copy of anything you signed from the operator, and we email you a copy when you sign.
6. Your responsibilities as a guest
Give accurate details, follow the operator's rules and the law, and only let people the rental agreement allows operate the equipment. You are responsible for the people in your party.
7. For operators and staff
Operators are responsible for their rental agreements, safety practices, licenses and permits, insurance, taxes, and for meeting the laws that apply to their business, including boating livery rules. Statutory text supplied in the product is a starting point that the operator's counsel should approve. The operator is responsible for how its staff use the product.
WakeSync is a software provider. It is not a party to any rental, waiver, release, policy, agreement or damage waiver between an operator and its guests. The operator alone is responsible for the content, legality and enforceability of its documents, including any starter templates it chooses to use, and for age, identity and boater education checks. Starter templates and compliance packs are provided as is for convenience, may be out of date, and are not legal, insurance or tax advice; the operator's own attorney should review them. We do not guarantee that any signature, release or waiver will be enforced, and operators should keep a paper fallback for times the service is unavailable.
An operator that offers a damage waiver decides its price and terms, keeps the fee, and is responsible for making sure offering it is lawful where it operates. WakeSync does not sell, solicit or negotiate insurance and receives no commission on insurance. The operator is the controller of its guest data and WakeSync processes it on the operator's behalf, keeps signed records for the configured retention period, and provides an export.
The operator will defend and indemnify WakeSync against claims arising from the operator's documents, rentals, accidents, injuries, damage charges, chargebacks and regulatory violations.
Operators receive payments directly through their own Stripe account and are responsible for refunds, disputes and chargebacks on their charges. We charge the fees in the operator's agreement, including a platform fee and a card processing markup on each card charge, collected through Stripe at the time of each charge.
Keep your sign-in private, use two-step sign-in where your organization requires it, and tell us right away about any unauthorized use. Do not use the product to send messages without consent, to sell anything unlawful, or to probe or disrupt the service.
8. Texts and emails
Booking messages (confirmations, reminders, weather and safety updates, receipts) are sent for your booking. Text messages are only sent if you opt in. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Marketing messages are only sent with separate consent, and you can unsubscribe at any time.
9. Availability of the service
We work to keep the service running and your data safe, but it is provided as is and may sometimes be unavailable. We may change or improve features. If we make a material change to these terms, we will update this page and the date above.
10. Limits of our liability
To the extent the law allows, we are not liable for the rental itself, the operator's equipment, conduct or decisions, weather, or indirect or consequential losses. For operators, our total liability is limited as set out in the operator agreement. Nothing in these terms limits liability that cannot be limited by law.
11. Governing law and contact
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Questions: support@wakesync.app. For anything about a specific booking, contact the operator first.
